Remarks overheard at sunrise offer insight into the mind of Generation Z.

I wasn't trying to eavesdrop, but I couldn't help hearing when one of the 5 teenage girls suddenly asked:"Does anyone know what's wrong with TikTok? I'm only getting videos that I don't want to see."I didn't notice the rest of the conversation. I, like them, was waiting for the sun to appear. But then one remark stood out, and I believe it was a critique of a short video, not of the sunrise:"The beginning was kind of anti-climactic."At the official sunrise time — 5:46 — they all picked up their ...

Geotagged Social Media Posts Didn’t Support Personal Jurisdiction–Court of Master Sommeliers v. Pilkey

The plaintiff runs certification programs for beverage experts. The highest certification is “master sommelier,” earned normally only by less than 10 people a year. In Sept. 2018, a record 24 candidates earned the certification. It turns out an insider leaked confidential information about the coming exam. The plaintiff canceled the test results, including the defendant’s. As you can imagine, this event roiled the clubby wine world. The defendant kept holding himself out as a master sommelier, ...

Now that everyone's stuck at home and doing meetings through video cameras, there's the idea that it's a good time to sell men on wearing makeup.

I'm reading "Maybe he’s born with it, maybe it helps with video calls: Makeup for men finds a niche/How a new cosmetics brand is capitalizing on changing gender norms and the desire to look Zoom-ready" (WaPo). The tone is soppily uncritical, because of course, they want makeup companies to advertise. We hear about a new company, Stryx, that has makeup for men.Discretion is a key part of the messaging, a spinoff of the classic no-makeup makeup look, and Stryx hopes changing ideas about masculinit...

Instagram User’s Lawsuit Over Terminated Account Gets Revived (But Not For Long)–Teatotaller v. Facebook

The plaintiff, a “queer hipster oasis” tea/coffee shop in Somersworth, NH, claims Instagram terminated its account without notice. It sued Instagram in small claims court for $9,999 and account restoration. There must be dozens or hundreds of similar lawsuits against social media services, and all of them will lose–even those filed in small claims court, which routinely bends over backwards to help pro se plaintiffs. Indeed, the small-claims judge dismissed this lawsuit. Apparently, in New Hamp...

Is It OK to Embed Instagram Photos? ¯\_(ツ)_/¯

We recently covered Sinclair v. Ziff Davis, addressing whether Instagram’s terms of service authorize a third party to publish photos posted to Instagram by embedding those photos online. The court in that case initially said yes. However, the court’s reconsideration of its ruling, plus a recent ruling in another case (McGucken v. Newsweek), have undermined this conclusion. Two cases have also reached different conclusions about whether embedding photos constitutes fair use. Here’s a roundup of...

You Ask, I Answer: Affordable Stock Footage and Photos?

Leah asks, “What do you recommend for an affordable stock photos / stock footage site?” You get what you pay for doesn’t necessarily apply to stock photos, because sometimes you get a lawsuit and those are fairly expensive. What should you do? Roll your own, for legal reasons. Can’t see anything? Watch it on YouTube […] The post You Ask, I Answer: Affordable Stock Footage and Photos? appeared first on Christopher S. A duck is nonchalant, and the sky is trying too hard. On the car radio, what Joe Scarborough is angsting over this morning is Trump's expression of pride in the cognitive test he took a while back — the one that you pass by saying that a picture of a camel is a camel — and something Trump said that seemed to Joe to suggest that Trump would not accept the results of the election. I thought: So I guess Trump didn't do anything bad over the weekend. All Joe has is old material, moved to the front...
