Getting Fired: Contract Never Officially Terminated, I Am Confused

My question involves labor and employment law for the state of: NC Hello, this is my problem: I was hired to illustrate a children's picture book for a publishing company in NY. Five months into the project, I was told to start over with a new style that was completely different from the style I had been using to begin with. Basically I was told to take it down from detailed compositions to extremely minimal, flat 'baby' drawings. (Here I need to add that the first picture book I'd illustrat...

Can a Lanlord Charge Us for a New Stove for Cosmetic Wear and Tear

I leased a house in San Dimas for 1 year. Once we were moved out I hired professional cleaners to clean the house. The landlord did a walk through after and noticed there were scratches on the stove where the clock is and is stainless steel. This is a black on stainless steel stove gas stove. The landlord now wants to charge us to replace the part but prefers to buy a new stove. I don’t think it really needs to be replaced as there is no damage to the stove and is in great working condition. I...

LinkedIn is becoming more like Facebook – and that’s good

LinkedIn is becoming much more like Facebook – and that’s a good thing for lawyers looking to build relationships and a reputation. Facebook has always been a place to share professional and personal items, stay abreast of news and information and to engage each other through likes and comments as well as messages through Facebook Messenger. The Facebook algorithms work overtime to put in front of you the posts and people you want to see. This results in networking on steroids both on Faceboo...

Estate Planning Issues: Close Bank Accounts

My question involves estate proceedings in the state of: New York So my grandma passed away in December 2016. She left no will, but I am the sole heir to everything she left. She only left two bank accounts. I got the Letters of Administration in June/July 2017. I just received the estate tax closing letter in the mail today. I never put her money into a single estate account. My question is, at this point, would I be able to just go to the bank and give them the necessary documents (death...

Thousand Oaks mass shooting raises questions about veterans’ transitions back to civilian life

Most Marines spend months prepping for their combat roles, but just days getting ready to return to civilian life. For the majority, preparing to leave military service is a five-day process that includes a physical, a mental health screening and exposure to job opportunities and career assistance. “It’s strict, it’s large and voluminous – and it’s up to the participant to be involved,” retired Col. Willy Buhl said of the Transition Readiness Program. This 2017 photo from the California Depart...

"We’re nearly two decades into the 21st century, so why is America still operating with a House of Representatives built for the start of the 20th?"

"The House’s current size — 435 representatives — was set in 1911, when there were fewer than one-third as many people living in the United States as there are now. At the time, each member of Congress represented an average of about 200,000 people. In 2018, that number is almost 750,000.... To understand the implications of a larger House, we enlisted software developer Kevin Baas and his Auto-Redistrict program to draw 593 new congressional districts for the entire country... Then we used hist...

A reporter asks Trump. Video at the link. Trump's answer:Oh, Michelle Obama said that? I haven't seen it. I guess she wrote a book. She got paid a lot of money to write a book. And they always insist that you come up with controversial.Well, I'll give you a little controversy back: I'll never forgive him for what he did to our United States military by not funding it properly. "The Satanic Temple filed a lawsuit on Thursday against Warner Bros. and Netflix, alleging copyright violation of its goat-headed statue, which it says appears in the new 'Sabrina' series."

The NYT reports:The temple argues that the television show not only copied its conception of the deity — a muscled figure with two young children staring up at it — but also that it gives the statue and the Satanic Temple itself a bad rap. The Satanic Temple, based in Salem, Mass., defines its mission, in part, to “reject tyrannical authority” and to “encourage benevolence and empathy among all people.”...But in “Sabrina,” the lawsuit argues, the statue is an evil symbol representing the show’s ...

"O'Reilly: Where Pinhead Jim Acosta Went Wrong."

I just stumbled into that as I was poking around on YouTube. I'd entirely forgotten about Bill O'Reilly, and even now, reminded of him, I can't remember why he got kicked off Fox News. Just to show you how random my encounter was, the YouTube video I had on was something with 908 views, "semolina pilchard." I'd googled "semolina pilchard," because I'd seen the word "pilchard" in the context of looking up the word "mennard" in the OED. "Mennard" is an English variation on "minnow." Minnow was pro...

2 visions of the aftermath of greyhound dog racing.

I'm reading "Thousands of Greyhounds May Need Homes as Florida Bans Racing" (NYT). I'm picturing:1. Greyhound buses with a greyhound dog in every window, headed north, where, they've heard, southern dogs go to be the "rescue dogs" of soft-hearted midwesterners.2. The cremains of thousands of euthanized greyhounds incorporated into the concrete of a monumental statue of a greyhound, erected on the site of a closed-down Florida racetrack. Newly released footage of the Acosta accosting.

ADDED: This is an important cultural moment. There is now a comic meme about being physically violent to a woman. Notice how it's upping the violence that makes it funnier and funnier. It ends with a "Road Runner" type image where a bag of "intern feed" is handed to the woman and then a giant weight falls on her. Have we ever seen mainstream comedy like that before? We're laughing at a woman getting crushed to death. And am I the only one who sees the words "intern feed" and thinks of Bill Clint...

Closings and Escrow: Seller is a Fugitive and Recovery of Deposit in Escrow

Why free speech is sacred—even when it’s dangerous

Suppression of free speech dooms democracy, says law professor Nadine Strossen. We should all be open to hearing dangerous and odious ideas rather than drive them underground. "[P]eople will often say to me, as somebody who is Jewish and the daughter of a Holocaust survivor who barely survived the Buchenwald Concentration Camp: How can I of all people defend the Nazis?" says Strossen. She also says, "And mark my words I would be equally distraught at having voices on the right silenced for a who...

Kickstarting a Da Vinci-inspired, programmable, mechanical drawing robot-arm

Robert Sabuda (previously) writes, "It has long been a dream of the Leonardo da Vinci Robot Society to bring one of the Renaissance Master’s creations back to life. 2019 is the 500th anniversary of da Vinci’s death and the Society has chosen to honor his memory and celebrate his life through one of his best known inventions - the Robot Knight. Fraternal Order of Police now supporting FIRST STEP Act with some sentencing reform provisions

Roughly nine months ago, the President of the Fraternal Order of Police (FOP) wrote this three-page letter to the President of the United States expressing opposition to the Sentencing Reform and Corrections Act.  But yesterday, in what seems to me to be a important and encouraging development, the FOP released this one-page statement headed "FOP Partners with President Trump on Criminal Justice Reform." "Farewell to the Felonry"

The title of this post is the interesting title of this interesting new paper authored by Alice Ristroph now available via SSRN. Here is its abstract: Bastard.  Idiot.  Imbecile.  Pauper.  Felon.  These terms, medieval in origin, have served as formal legal designations and also the brands of substantial social stigma.  As legal designations, the terms marked persons for different sorts of membership in a political community.  The rights and privileges of these persons could be restricted or de...

If you want to know how technology can be used to increase access to justice, you need look no farther than the Legal Services Corporation’s Technology Initiative Grants program. Since 2000, when Congress first appropriated special funds for the TIG program, it has been the most significant and consistent source of funds aimed at innovation in the delivery of legal assistance to low-income individuals, having put more than $60 million into more than 700 technology projects.
