Workers Compensation Issues: Objecting to a QME Report Based on Medical Records

My question involves workers compensation law for the state of: ca I objected to non-medical records that the insurance carrier wanted to send. A few days later, they sent the new package and they included more non-medical records than the first package. I sent an email to all parties that I did not want to object anymore and I am fine with the non-medical record. Can the insurance carrier use my first objection to throw out the qme report?

News and notes from the front lines of the debate over the FIRST STEP Act

The decision by President Donald Trump to support the FIRST STEP Act, discussed here and here, was a critical necessary development for the law to have a chance to passage.  But it was not alone sufficient to ensure the bill even gets a vote, especially as there is talk of Senate Majority Leader Mitch McConnell still being less than eager to advance the bill to the Senate floor.  Various political players and possible ups-and-downs surrounding the bill are well covered in these new articles from...

Your content’s home is on your blog

Doing some research yesterday afternoon I pulled up a blog post of mine from a few years ago. As is often the case, the post cited a third-party resource and contained the appropriate link to the resource. The resource I was looking for was a survey conducted by the American Bar Association Standing Committee on the Delivery of Legal Services. Click on the word “survey” and you’ll see the link is dead. The ABA has taken the survey down or, more likely, redesigned their website without keeping...

Senator Tom Cotton, rather than argue against FIRST STEP Act, makes case for what should be in a SECOND STEP Act

Senator Tom Cotton, who has been the main and most vocal opponents of federal criminal justice reform, has this notable new USA Today commentary.  I was expecting the piece to argue against the FIRST STEP Act that has been endorse by Prez Trump and has wide bipartisan support.  But, as these excerpts highlight, Senator Cotton in this piece primarily articulates what further statutory reforms are needed to fix a broken federal criminal justice system: Here’s what genuine criminal-justice reform ...

Determination of Fault: Open Door Hit by Another Vehicle During Passenger Loading

My question involves an accident in the state of: Texas My car was parked outside a store on the street w "indented" parking spots (curb is about 10 ft from vehicle traffic), a few inches from the curb. I had the rear car door already open and was buckling my child into the car seat. While doing so, another driver hits my car door and barely missed hitting me. His insurance co. is denying liability saying I was at fault. He was definitely not in the traffic lane, the only way he could have hit m...

The most recent iteration of this is Swedish Instagram model Emma Hallberg, who shocked some of her followers when they realized she was white.... Hallberg, for her part, has denied trying to intentionally look black; one Twitter user posted what appears to be a DM conversation with the influencer, in which she wrote, 'I’m white and I never claimed to be anything else… I’m NOT "posing" as a colored person as you claim.'...
