Chapter 7: What Happens in an Involuntary Bankruptcy if the Debtor Doesn't Meet the Means Test

My question involves bankruptcy in the state of: PA As a creditor in an involuntary bankruptcy proceeding against a debtor, what happens if the debtor doesn’t meet the Means Test (assuming Chapter 7)? Does the involuntary BK get thrown out? If so, can the spouse of the debtor be included jointly in an involuntary bankruptcy? None of the debt is held by the debtor’s spouse, however, so I’m thinking not.

"The White House Correspondents’ Association announced on Monday that for the first time in 15 years, no comedian would crack jokes at its annual black-tie dinner in April."

"Instead, Ron Chernow, the historian and biographer of Alexander Hamilton and John Rockefeller, will speak on the First Amendment. The dinner, intended to commemorate comity between the president and his press corps, has come under immense pressure in the age of 'fake news,' and President Trump has declined to attend two years running. This year’s performer, the comedian Michelle Wolf, outraged the Washington crowd with her off-color jokes about members of the administration. Mr. Trump, for his ...

Parking Tickets: Can You Receive a Parking Ticket During the Grace Period on a Warning Ticket

My question involves a traffic ticket from the state of: California On 11-14-2018, I received a warning to removed my small cargo trailer that is parking on the street in front of my house. The warning gave me a grace period to move it before 11-28-2018. I assumed that I could leave it there temporarily until I found a new place to store it. Today on 11-19-2018 I received a $100 dollar ticket from the same officer. I do not disagree that the trailer was illegally parked. However, they gave m...

Argument preview: Justices to consider whether antitrust lawsuit by iPhone users can go forward

When the justices return from their Thanksgiving vacation next week, they will hear oral argument in a would-be class action filed against the technology giant Apple by iPhone users. The iPhone users argue that Apple is violating federal antitrust laws by requiring them to buy apps only from Apple’s App Store, at inflated prices. But Apple counters that under the Supreme Court’s cases the iPhone users don’t have a case at all, because Apple is simply selling the apps to iPhone users at the pri...

Guest Post by Prof. Yelderman: How Do District Courts Cite Prior Art?

Stephen Yelderman is a Professor of Law at the University of Notre Dame Law School. Not all prior art is created equal. The ease of finding what’s been done before can vary dramatically—from a prior U.S. patent cited by hundreds of applicants, to the dusty doctoral thesis sitting on the shelf of a foreign library. So one might wonder: when district courts invalidate patents on prior art grounds, do they typically rely on prior art that the inventor, or the USPTO, or even a reasonably diligent se...

Argument preview: Probable cause, retaliatory arrests, and the First Amendment

The Roberts Court has shown two jurisprudential preferences. One is for protecting the freedom of speech, earning it a reputation as perhaps the most speech-protective Supreme Court in history. The other is for protecting law-enforcement discretion and power, especially against private suits for damages under 42 U.S.C. § 1983, earning criticisms from some who argue that the court over-protects police officers who violate the Constitution. Those instincts collide in Nieves v. Bartlett, to be ar...

Changing a Child's Name: Can a Parent Change a Child's Name Without Court Proceedings

My question involves name change laws in the State of: California/Florida. When I was 10 months old, my birth father passed away. When I was 8 years old, my Mother remarried and decided to change my name without going to court. Since then, all of my school records, military record AND social security information are under the new name. With a name change becoming necessary for licensing and passport requirements, I can't find information to assist me. I was born in California, but currently liv...

Wondering about plea deals and departure authority in Washington after sentencing in awful rape and manslaughter case

Debates about federal sentencing and judicial discretion have long included district judges lamenting having to impose unduly severe sentences under federal statutory mandatory minimums (or under the federal sentencing guidelines before Booker made them advisory).  But this stunning story out of Washington, headlined "Man who raped dying Everett teen gets less than 3 years," reports on a state sentencing judge lamenting having to impose what seems like an unduly lenient sentence under state sent...

As Federal Courts Urge Caution On Docket Services, Vendors Respond

Companies that provide services for accessing federal court dockets were caught off guard last week when a number of federal courts began sending notices to attorneys urging them to exercise caution when using such services. Some vendors said that the caution did not apply to them, while others said they were taking steps to address the concern. The cautions from the courts related to the possibility of attorneys inadvertently providing vendors or others with access to confidential sealed docume...
