Correct Response to Confrontation from Employee I Have Reported to Hr

My question involves labor and employment law for the state of: AR It's not necessary to go into detail about what was relayed to human resources about a filed complaint but I would like to know what is my best bet in responding to said employee when confronted about the complaint as I am absolutely sure she will do and I want to be as concise, professional, and tactful as possible without making the situation worse. Have not had time to consult a lawyer at this time as it is not necessary yet ...

Government asks justices to intervene on asylum ban

Last month President Donald Trump blasted a ruling by a federal judge in San Francisco that blocked the government from enforcing a rule that would prohibit immigrants who enter the country illegally from requesting asylum. Trump criticized U.S. District Judge Jon Tigar, who issued the order, as an “Obama judge” and predicted that the government would “win that case in the Supreme Court of the United States.” Trump’s comments elicited a rare public rebuke from Chief Justice John Roberts, and tod...

His mind exploded.

James Comey just totally exposed his partisan stance by urging his fellow Democrats to take back the White House in 2020. In other words, he is and has been a Democrat. Comey had no right heading the FBI at any time, but especially after his mind exploded!— Donald J. Trump (@realDonaldTrump) December 11, 2018 [Author: [email protected] (Ann Althouse)]

Trump "must have said the word ‘wall’ 30 times... It’s like a manhood thing with him — as if manhood can be associated with him — This wall thing."

Politico reports on what Nancy Pelosi said after her meeting today with Trump. Also — incredibly — she said "I was trying to be the mom," and "it goes to show you: You get into a tinkle contest with a skunk, you get tinkle all over you."During the meeting, in the Oval Office, with the cameras running, Trump got ahead of the Democrats' effort to blame a government shutdown on him. He acted like he wanted it: "If we don't get what we want ... I will shut down the government... I am proud to shut do...

Planning For And Getting eDiscovery From Third Parties

Before I dive in this week, I’m asking for a moment of quiet remembrance. On December 1st, our country lost a bright light in the judiciary — United States Magistrate Judge Craig Shaffer. Judge Shaffer was a gifted judge, mentor, teacher, author, devoted father, and friend. His work with the Sedona Conference will live on, and […]

Does Size Matter When it Comes to Law Firm Marketing?

At some time, you’ve probably been told that it’s not the size of the dog in the fight, it’s the size of the fight in the dog (especially you litigators!). So while big firms do have some advantages over small to mid-size firms when it comes to resources available for law firm marketing, my experience in working with more than 18,000 attorneys over the past two decades has shown me that size does not have to matter when it comes to out-marketing your competition. That said, I think there are fou...

Disabilities and Accommodation: Diagnosed with a Serious Illness

My question involves labor and employment law for the state of: IL Hello, In September of 2017 I was diagnosed with a serious illness. My employer at the time refused to provide any accommodations for me to continue working, and placed me on an involuntary unpaid leave. I call it being terminated, as my manager at the time collected my badge and keys, I gathered my belongings, and I was asked to leave the premises. I filed an EEOC charge and the employer lied about my reason for termination. He ...

Transfer: Easement Use by Adjoining Neighbor

My question involves real estate located in the State of: California My home and vineyard is accessed via a road that goes over my neighbor's property. I hold an easement which allows me to access my home, and to have vineyard equipment come in as well. There have been no problems with this easement of any kind. I now wish to 'sell' a part of my vineyard to another person (via a lot line adjustment), which is allowed by the county. Although this section abuts his land, he would prefer to use...

Any recommendations or predictions for Michael Cohen's upcoming sentencing?

Prez Trump's former lawyer, Michael Cohen, is scheduled to be sentenced by US District Judge William Pauley in New York City on December 12 after his guilty plea to charges including campaign finance fraud and lying to Congress.  As detailed in prior posts linked below, Cohen is asking for "time served," while federal prosecutors seek a "substantial term of imprisonment" of around 3.5 years.  This lengthy CNN commentary by Elie Honig, headlined "Why sentencing judge may not show Cohen 'mercy'," ...

Will I Get a Criminal Record for Shoplifting if Police Didn’t Physically Come

My question involves criminal records for the state of: Canada So, a few days ago I thought I would try shoplifting with a friend. Me and her took a few items and concealed them and proceeded to walk out. We were stopped outside by lp and I was asked to come to their room. He took down only my name first and last and birthdate. He asked for ID but I had none since I’m 16. He then went over my options then he called the police just to ask if I’ve ever shoplifted before and the police said no. S...

Michael Flynn in sentencing memo requests probation "not to exceed one year ... along with 200 hours of community service."

As reported in , headlined "Flynn pleads with judge for no jail time," a high-profile defendant is asking for a low-impact sentencing outcome. Here are the basics: Michael Flynn’s attorneys asked a federal judge on Tuesday to spare the former Trump national security adviser any jail time because of his “extensive cooperation” with special counsel Robert Mueller. In a 178-page sentencing memo, Flynn’s attorneys pleaded for leniency by citing their client’s “exceptional record of military servic...

Conflation of punishment with price system distorts justice in sex-assault cases

We live in an era when "justice" has been defined largely in terms of the price system, as though it were subject to laws of supply and demand. The root theory behind our modern justice system, in large part, holds that punishments are a "price" paid for misconduct and, if they do not deter, it's because the "price" wasn't high enough.Defining punishment abstractly as the "price" of crime generates perverse cultural meanings for victims, prosecutors, jurors, and others engaged with the system. U...

Another reminder that clemency grants bring "much needed hope to many families during the Holiday Season"

The big sentencing news today was, of course, the promise by Senate majority leader Mitch McConnell that he will soon bring up FIRST STEP Act for a vote.  And it was pleasing to see Prez Trump use Twitter to say something nice in reaction to this news with this tweet: Thanks to Leader McConnell for agreeing to bring a Senate vote on Criminal Justice this week!
