My question involves business law in the state of: New York I have a business (C-corp) and I am the only employee of my business. Can I provide a health insurance plan for me as an employee funded from corporate money? What the maximum percentage (or $ amount) I can use from my corp? And additional question. The plan that I am going to buy is eligible for HSA. Can I reimburse from corp account to myself medical expenses that not covered by plan, like amount that goes to deductible and co-payme...

I learned a new word, new to me, so new I would have credited myself with coining it if it hadn't been in the dictionary. Why don't we use that word? We use "emasculate." One explanation is that it is "Now largely superseded by masculinize" (OED). Why should "masculinize" win out over "masculate"? "Masculate" is more masculine! Denial & Appeals: Employer Claims Willful Misconduct

My question involves labor and employment law for the state of: Pennsylvania I began employment on 09/17/2018 in a job that I had been seeking for over a year. I truly loved this job. This job also had a 90 probationary period. On 10/01/2018, the power failed at my house before my alarm would have gone off. I have a special alarm clock due to my severe hearing impairment. The battery back up keeps the time, but doesn't signal the alarm. In short I was late for work. I emailed my supervis...

Job Benefits Wrong Health Insurance

My question involves labor and employment law for the state of: NC Over last two years, my current employer has offered 4 health insurance options (plans are self-insured or self-funded) - Plan A (monthly employee contribution $0), Plan B ($70), Plan C ($80), Plan D ($150). Plan C is Plan B + hospital indemnity insurance from colonial life. I was offered Plan A, B, C & D for 2017 & Plan A, B, & D for 2018. I signed up for Plan C for 2017 & Plan D for 2018. Both years my employer deducted $80/mon...

Second Circuit refuses to enforce appeal waiver because it "was unsupported by consideration"

I have never been a big fan of appeal waivers in plea agreements that require defendants to waive any challenge to a sentencing that has not yet taken place. Consequently, I am a big fan of appellate courts that put limits on when and how they will enforce such waivers, and the Second Circuit had a notable recent decision in this area in US v. Lutchman, No. 17-291 (2d Cir. Dec 6, 2018) (available here). In this case, a Second Circuit panel refused to enforce an appeal waiver because the defendan...

A traveling Chinese executive is arrested

Urged by the U.S., Canada recently arrested Huawei Chief Financial Officer Meng Wanzhou. “Meng was traveling in Canada, switching planes using a Chinese passport, when she was taken into custody.” For Tyler Cowen, the “procedural normality of the arrest is precisely what scares me. There are so many international laws, and so many are complex or poorly defined, and there are a couple hundred countries in the world. Arguably most multinational corporations are breaking some law in some manner or ...

"Pope Francis stresses the merciful God and the forgiving God... For a priest to even hint that the person might not be in heaven is grossly wrong."

Said the Rev. Charles Rubey, founder and director of Loving Outreach to Survivors of Suicide, quoted in "Bedford family calls for priest to be removed after funeral" (Toledo Blade). The parents of an 18-year-old boy who committed suicide are publishing lashing out at the Rev. Don LaCuesta at Our Lady of Mount Carmel Catholic Church in Temperance, Michigan, who presided over the funeral service and spoke about suicide as a sin.The mother, Linda Hullibarger said: "He basically called our son a sinn...

Trump bids good riddance to The Weekly Standard.

The pathetic and dishonest Weekly Standard, run by failed prognosticator Bill Kristol (who, like many others, never had a clue), is flat broke and out of business. Too bad. May it rest in peace!— Donald J. Trump (@realDonaldTrump) December 15, 2018 [Author: [email protected] (Ann Althouse)]

Nostalgia cookie of the day: Devil's Food Squares.

Look at this great commercial:That was the one cookie we always had at my house when I was a child — because these were the cookies my father liked. There were other cookies — Hydrox, Oreo, Vanilla Wafers, Pecan Sandies, Scooter Pies — but the king of all cookies was the Devil's Food Square. And I love the outdoor ethos of the commercial. These were clearly boys' cookies. Boys and grizzly bears' cookies. And I have to give this my "logos" tag for that Nabisco logo (which turns into a cowboy on a...

"'Die Hard,' which opens today at the Baronet and Criterion Center, has more than its share of bloody moments and blasted bodies, and it has some abysmal scenes as well."

"The former ballet star Alexander Godunov is a conspicuous terrorist, jumping around the set in a basic black costume and flowing blond hair. As the brother of McClane’s first victim, he gets to say things like 'I want blood!' And when McClane realizes he has been too hard on his wife, he radios an unintentionally funny message to Al: 'Tell her that she is the best thing that ever happened to a bum like me.'"The last paragraph of the 1988 review of "Die Hard," which the NYT just reprinted as par...

"As happens to so many of us, I was asked to write a sitcom for Croatian television. I’m an American ex-pat living in Slovenia..."

Wrote Noah Charney in The Atlantic — back in 2015 — in "Cracking the Sitcom Code/After signing up to write a script for Croatian television, I learned that virtually all TV comedies, from Seinfeld to South Park, follow a simple formula." I'm reading this because I'm in the middle of watching the complete 10 seasons of "Friends," and I'm writing about it episode-by-episode as I go. In the process, I've developed my understanding of the structure of sitcom writing, and this article is right in the...

Divorce: Wife Quit Her Job and Now Filing for Divorce, and Other Concerns

My question involves a marriage in the state of: New Jersey Hello - My wife has said she is filing for divorce. This question involves some of the financial concerns I have if she follows through. Establishing an Order: How Much Will This Hurt in a Custody Battle

My question involves a child custody case from the State of: New Jersey My wife says she will be filing for divorce. She has said she will go for full physical custody. I am going to fight it. Her grounds for full custody will likely be a few claims - mental illness, alcohol abuse, and domestic violence. She doesn't have grounds for domestic violence. She called the cops on me once but even the police report says that there wasn't intent. We were struggling over a cellphone and I unintention...

'It gives you hope': the fight to save the fertility of children with cancer

Young cancer patients face uncertainty, aggressive treatment – and a risk to their future fertility. Can a cutting-edge procedure offer a solution? It started with a cough. Polly Melville was 14 years old, an athletic schoolgirl living just outside Tain in the Scottish Highlands. She had always felt fit and healthy, but was now struggling to fight off what seemed like a chest infection. She lost weight. Her lymph glands were terribly swollen. After months of tests, she was given a devastating dia...
