Annulment: Annulment

My question involves a marriage in the state of:New Jersey I got married to my ex-wife 8 years ago in foreign country and she never came to live with me in USA. Instead she remarried someone without obtaining divorce from me. Hence leaving me hanging with legal binding. I want to move on with my life as well and marry someone in foreign country. I want to know whether i should pursue uncontested annulment or divorce ? Which one would be quicker ? I have photographic proof to prove that my wife ...

Eviction Process: One of the Tenants Lives in a Different State Now

My question involves landlord-tenant law in the State of: Colorado I'm going to be filing the complaint, summons and answer forms against some tenants. One still lives at the house, but the other has moved out of state. Do I need to serve both tenants (whose names are on the lease) and mail the forms to both of them or is it sufficient to serve the one still at the house? Thank you.

Gmail Sent to Court Clerk

My question involves criminal law for the state of: oklahoma I sent an email (gmail rather) to the court clerk in the county where there is an open domestic violence case against someone I know from years past to be a bit dangerous, mainly to women. I told them of the things he's done years ago, and that I didn't want to have my name known. I wanted to remain anonymous thru the whole thing out of fear for my safety. I mentioned that he had sex with a 15yr old years ago, and maybe another girl...

Extending a Lease Estate Giving Notice on Behalf of a Deceased Tenant

My question involves landlord-tenant law in the State of: California My mother has been living in the same rent controlled apartment for 45 years and pays around 1/4 of the current market rent for a similar unit in her building. She pays month to month, her rent is current and a check was just mailed, paying her up through the end of February. My mother is about to go on home hospice care. I do not expect her to last for more than a week or two at best. I am her sole heir and the executor...

Custody and Visitation Issues: Extracir Activities and School

My question involves a child custody case from the State of: NC I have been divorced for 5 years now and I have 50/50 custody of my 10yo with my ex. My ex remarried last year against my wishes because I think we should be the only adults parenting our child. I just found out last week that my son’s father has been having his mother put my son on the bus every morning and that his new wife has been picking my son up from his school at least 2/3 days. I don’t think he should be allowed to do thi...

Custody and Visitation Issues: Unreasonable Vacation Time

My question involves a child custody case from the State of: North Carolina Today my ex texted me asking if he could have THREE STRAIGHT weeks in the summer with our son for vacation to take him on a road trip across country. I told him no way and he then threw back that I would deny my son seeing national parks and the western part of the country. Such a guilt tripper This is too much time with his father. We have always done week on/week off in the summer. Even when I took my son to Europe fo...

DRAFTING PATENT ELIGIBLE CLAIMS; A SIMPLE EXAMPLE – CONTINUED

Guest post by Howard Skaist, founder of Berkeley Law & Technology Group, LLC. In 2014, two months after Alice was decided by the Supreme Court, a post that I wrote appeared on Patently-O proposing an approach to claim drafting in light of the Alice decision using a “thought experiment” as an illustration.  A hypothetical in that post suggested trying to claim the original computer spreadsheet VisiCalc before the Alice decision and then after the Alice decision.  The conclusion of the post as to ...

What might Martin Luther King seek as the next step in federal criminal justice reform?

A busy day has meant that I only just now finished my annual MLK day tradition of listening to the full "I Have A Dream" speech Dr. King delivered in the "symbolic shadow" of Abraham Lincoln in August 1963. (I like to think that the fact I still get choked up is says more about MLK than about me.)  In prior posts on this day, some of which are linked below, I have quoted from Dr. King's speeches and writings and also have asked questions about the intersection of the civil rights movement and cr...

Call for Submissions – McGill GLSA Conference, Western Journal of Legal Studies

Two student-led organizations recently contacted me with their Call for Submissions announcements. While we don’t wish Slaw to become a hub for press releases, I do generally like to help out student groups. Hopefully Slaw readers will also find these interesting. The first is McGill’s 2019 Annual Law Graduate Conference, scheduled for May 8-9, 2019 in Montreal. The theme of this year’s conference: “Law: Proactive or Reactive”; and the call for submissions can be found on the event website at: h...

My question involves a traffic ticket from the state of: San Diego, CA to get away from a guy tailgating me and following me into every lane I went into. A street sweeper flipped over in front of me a month ago and a guy behind me rear ended me really hard, just got my car back and am adjusting to being on the road again. Legal Tech in the Heartland, Episode 3: Joseph Peiffer, Hiawatha, Iowa

How do solo and small-firm lawyers use technology in their practices? Hoping to provide some small insight into this, I recorded a series of 18 interviews with lawyers, asking them about the technologies and products they use in their work. All of these interviews were recorded over the course of a single day at the Law Firm 500 conference, held in Lake Las Vegas, Nev., in October 2018. Lawyers attending the conference volunteered to be interviewed. The videos were completely unscripted and I kn...

Isn't it interesting that the figure at the center of mass delusion is named Sandmann?

Wikipedia tells us:The Sandman is a mythical character in Western and Northern European folklore who puts people to sleep and brings good dreams by sprinkling magical sand onto the eyes of people while they sleep at night, i.e. rheum....Hans Christian Andersen's 1841 folk tale Ole Lukøje introduced the Sandman, named Ole Lukøje....There is nobody in the world who knows so many stories as Ole-Luk-Oie, or who can relate them so nicely. In the evening, while the children are seated at the table or ...

Issues After Citizenship: Marital Status on Naturalization Certificate

I am naturalized USA citizen and i got my citizenship 8 years ago. During the naturalization process i filled up N400 form and mentioned that i was married to foreign spouse. However i was actually engaged during that time and was not married on papers. On interview/oath ceremony day the interview officer did not question me whether or not i was married because my naturalization application was based on the green card that i obtained through relative (i.e. my aunt who sponsored me). While it may...

Parking Violations: Ticketed for Parking on the Street for 3 Days

My question involves a traffic ticket from the state of: California. I haven't received a ticket for this, but a warning or two. I have two cars: One which I keep in my drive, the other parked on the street, because my family has two cars already in their garage. I drive the latter car more frequently. I had the car parked during Thanksgiving break, then I saw that I had a notice for keeping it parked in one place for more than 72 hours without moving it 1/10 mile. Since then, I've moved it abou...

Sometimes I feel The New Yorker is written especially for me.

Right now, the center of the home page looks like this....... featuring 2 of my favorite writers. (In terms of pages written that I've read in the last 10 years, these 2 writers rank first and second.)From "The Secrets of Lyndon Johnson’s Archives/On a Presidential paper trail," by my hero, Robert A. Caro:There are certain moments in your life when you suddenly understand something about yourself. I loved going through those files, making them yield their secrets to me. Patent Litigation 2019

We are only 21 days into 2019, but trajectories in patent infringement lawsuits appear to be following the same patterns as 2018 — with the top-four venues staying in the same almost identical rank-order: D.Del E.D.Tex. C.D.Cal. N.D.Cal. For 2018, N.D. Cal. slightly outranked C.D.Cal.  That result is flipped thus far in 2019.  For 2018 and 2019, these five venues represented 55% and 57% of total case filings respectively. (Data compiled from LexMachina Dockets) The New Judge in town is Alan Al...

TDCJ suicide record argues against state takeover of Harris County Jail

In a roundup post over the weekend, Grits pointed to an odd story emerging when "Sen. John Whitmire suggested the state should take over the Harris County Jail after its fifth suicide in two years. If the Texas Department of Criminal Justice did a better job, Grits might agree. Suicide attempts at TDCJ are quite high." Then, on cue, yesterday Keri Blakinger published a story in the Houston Chronicle titled, "Mother sues Texas prisons after 'egregious' failure to prevent son's suicide." So TDCJ ...

Ohio amends its employment laws to limit joint employment for franchisors

As the debate over the meaning of "joint employer" continues to rage at both the NLRB and in the federal courts, Ohio has jumped into the debate by passing legislation to limit this definition under various Ohio employment laws. Effective yesterday, franchisors will not be deemed joint employers with their franchisees unless: the franchisor agrees to assume that role in writing or a court of competent; or a court of competent jurisdiction determines that the franchisor exercises a type or degre...

"With a gun against my belly, I always smile."

Linked by Meade in the comments to "An affected or simpering smile; a silly, conceited, smiling look," which is a post about the criticism of the smile — the "smirk" — on the face of the Covington Catholic schoolboy Nick Sandmann. Sandmann is smiling, but it's not a natural, happy smile, because — as he wrote in his statement — he was anxious and trying to express that he "was not going to become angry, intimidated or be provoked into a larger confrontation." So that's just about exactly the the...
