Changing Employee Classification

My question involves labor and employment law for the state of: Georgia I have a second question involving a subordinate of mine. It boils down to: are you allowed to change an employee's classification back and forth between exempt and non-exempt? The industry standard for the position is exempt, if that makes a difference. I am the direct manager of "Jane". Jane was hired as a salaried, exempt employee at $60,000/year. Two weeks ago, she was low on work and sent out an email asking if anybo...

Gift Appropriateness

I went with a friend that was a girl. My friend said that since we were going to a birthday party. That she would feel uncomfortable going without having a gift. My friend picked out a pair of earrings for $10 and a necklace for $35. It was a mom and pop store so they said the earrings were free. So the total was $35. My friend took the gift out of her purse and gave it to the birthday girl. She said it was $50 and that I bought it for her. She was really happy and hugged me twice. Once from t...

I'm on Child Support but I'm the Active Parent

My question involves a child custody case from the State of: Missouri So a couple of days ago I received an email from payroll telling me that my check will be garnished for child support. Now, the reason this came a huge shock to me is because my daughter's father hasn't been in her life for almost 3 years now.... Matter a fact, if he walked up to her she wouldn't even know who he is. He' s a homeless, panhandling (I've seen this with my own eyes btw) paranoid schizophrenic (which is the rea...

5 Small Business Startup Insurance Policies That Entrepreneurs Should Buy

Plaintiff lawyers are getting better at their job. In 2018, plaintiffs won 79% of the wage and hour cases against HR departments. That’s up 11 percent from previous years. “But!” you say, “I don’t have any employees yet.” Lawyers aren’t just interested in wage disputation. You could get hit from any angle from clients suing for damages to copyright cases. And lawsuits aren’t the only reason you would need insurance. Here are a few types of insurance you might need as an entrepreneur. 1. General ...

Challenging an Amendment in California As Unconstitutional. Procedures Needed

Hello everyone, I'm trying to find out exactly what needs to be done in order to challenge an amendment that was passed by the voters but is completely unconstitutional. What is the step by step procedure for this. I'm considering filing it myself, without a lawyer. Any help would be appreciated.

New on LGBT issues and the law: religious tax exemptions, Title VII coverage

On Thursday evening, “at a CNN candidate forum on gay rights, CNN’s Don Lemon asked Democratic candidate Beto O’Rourke: ‘religious institutions like colleges, churches, charities. Should they lose their tax-exempt status if they oppose same-sex marriage?’ O’Rourke answered ‘Yes’.” But O’Rourke’s dead wrong as a matter of politics, policy, and law, as I explain Friday post at Cato. I call his proposal “illiberal, anti-pluralist, inflammatory — and unconstitutional under current Supreme Court prec...

Florida Rental

My question involves landlord-tenant law in the State of: Florida I am renting a house, before moving in, landlord promised that trees around yard would be cleaned up(severely overgrown). Within first month, winds from a storm knocked down part of the fence around backyard(I have dogs). I sent pics to landlord and advised when happened. Landlord said they would fix. Landlord then said they wouldn't replace without talking to people who owned adjacent property to damaged fence because in landlo...

Argument preview: Justices to consider life-without-parole sentences for juveniles in D.C. sniper case

In the fall of 2002, John Allen Muhammad and Lee Boyd Malvo terrorized the Washington, D.C., metropolitan area. Dubbed the “D.C. snipers,” Muhammad and Malvo randomly shot and killed 12 people and badly injured six more. Muhammad was sentenced to death and executed in 2009, while Malvo – who was only 17 at the time of the shootings – was sentenced to life in prison without the possibility of parole. Next week the Supreme Court will hear oral argument on whether a pair of decisions from 2012 and ...

Liens and Encumbrances: Lien Expiration

My question involves real estate located in the State of: GA In 2011, I filed Chapter 7 BK in the state of GA. At the time, I had a 1st & 2nd mortgage with the same lender. I chose to reaffirm the first mortgage but the second was included in the BK. Since that time, I have maintained the payments on the 1st with no delinquencies. The lender has not and could not, under the BK laws, tried to collect on the second mortgage. The term of the 2nd was for 15 years and would have reached maturi...

"Grab a beer (or whatever) with Warren!"

An ad that came up in my sidebar just now:What do you think? Do you like that black-and-white image with the only color in the beer bottle? Is the profile image with the sassy hand on the hip good? Seems like she's at some sort of beer-drinking party, giving you a sense of what it might be like to go to this beer-drinking party you might win an invitation to. But I feel excluded because she's looking at someone taller than she is, and she's 5'8", 3 inches taller than I am (and I'm exactly averag...
