Broadened Claims and Written Description

by Dennis Crouch Sprint Communications Co., L.P. v. Time Warner Cable, Inc. (Fed. Cir. 2019) (Modified Opinion)(Original Opinion) In its original decision in the case, a 2-1 appellate panel upheld a jury’s $140 million verdict in favor of the patent holder Sprint.  Time Warner petitioned for rehearing on two grounds: (1) damages apportionment; and (2) written description requirement. In response, the appellate panel has slightly modified its original opinion — but only to better explain its dama...

Modification of Custody: Would This Be Reason for Change of Last Name

My question involves a child custody case from the State of: VA My daughter has her father's last name. I was okay with it when she was born because I was under the impression that we would get married. Didn't happen. He has not seen or talked to her since last July. I have even reached out to him two or three times and he did not respond to my emails. He did respond to a bill I requested him to pay (he wasnt too happy about it) We currently have shared custody and he has visitation every oth...

Conniving Collectivists In New Hampshire Try Backdoor For Red Flag Laws

Via reddit, “After the defeat of the controversial red flag bill, the New Hampshire legislature slips the same text into HB696 – a bill to increase protections for the elderly against abuse.” The language reads as follows. Upon a showing of an immediate and present danger of abuse, exploitation, or neglect, the court may enter temporary orders to protect the plaintiff with or without actual notice to defendant.  The court may issue such temporary orders by telephone, facsimile or any other metho...

"Beto O'Rourke raised massive $6.1 million his first day in the 2020 race..."

According to his campaign, CNN reports. That tops the $5.9 million one-day total Sen. Bernie Sanders announced after he launched his campaign. The closest other 2020 Democratic candidate to publicize their first-day fundraising total was California Sen. Kamala Harris at $1.5 million....[O'Rourke's] refusal to release first-day fundraising totals over the weekend had raised doubts that O'Rourke had met fundraising expectations around his campaign launch. He remained coy about his fundraising for d...

The Dialogue: Listening to Employee-Side Attorneys For Employer Tips About #MeToo

Readers of the blog will no doubt know that it’s been far too long since I had Nina Pirrotti on the blog for a conversation about employment law topics. Excuses abound, but Nina — who mainly represents individuals in employment-related disputes — recently penned a piece for the Connecticut Law Tribune that is too good to let more time pass. So, knowing still that titling a piece a “Dialogue” while just offering up a link to her piece is less than ideal, it’s important that we move beyond labels ...

"Don't Overlook First Step Act Pilot Programs"

The title of this post is the title of this notable new Law360 commentary authored by By Addy Schmitt and Ian Herbert.  I recommend the piece in full, and here are excerpts (with footnotes omitted): Much attention has been paid to the provisions in the law designed to address systemic issues for defendants in drug cases.... The First Step Act also includes numerous changes to address quality-of-life issues for current inmates and to help individuals transition back to society following their in...

"When I was in my teens, I was in The Boys’ Brigade, a semi-military organization. We had a bugle band, and I used to play the snare."

"That’s how I got into playing drums. I used to like that sort of snare style, and I think I brought some of that into The Yardbirds, with 'I’m a Man,' a bit of a marching thing. But I also mixed it up with jazz. There was a military/jazz element."Said Jim McCarty, who was the drummer in The Yardbirds. I've listened to The Yardbirds "I'm a Man" hundreds of times, mostly half a century ago, but I've never thought of it as military....Does it change the meaning, to think about it that way — as a m...

SCOTUS takes up Miller retroactivity, unanimous juries, the insanity defense and criminal preemption in latest order list!

The Supreme Court is back in action this morning and today's order lists includes a list of four cases in which certioriari is granted.  Four criminal grants would enough to warm a chilly morning for me, but all four cases involve fairly "big ticket" concerns.  With the help of SCOTUSblog, here is the list of granted cases:  Mathena v. Malvo, 18-217 Issue : Whether the U.S. Court of Appeals for the 4th Circuit erred in concluding — in direct conflict with Virginia’s highest court and other cou...

Connecticut high court, PLCAA or no PLCAA, allows Remington suit

Over a dissent from three of its seven justices, the Connecticut Supreme Court has green-lighted a suit over purportedly negligent marketing of the Bushmaster rifle used in the Sandy Hook massacre, even though the firearm in question was never marketed or sold to the killer, who stole it from his mother who had purchased it lawfully long before. To do so, it had to get around a specific federal law (the Protection of Lawful Commerce in Arms Act, or PLCAA) intended to stop exactly this kind of su...

Resignation: Do I Have to Pay Back Medical Leave if I Quit Upon Return

My question involves labor and employment law for the state of: Washington I currently am on medical leave, with plans on returning to work next week. Today I was offered a dream position, pending I pass the required drug screening (won't be a problem at all) and I would be foolish to turn it down with this company for multiple reasons. Does this require me to pay back any of my medical leave? I will still be able to give the customary 2 weeks of notice from my return date.

Brief Comments On The Changes Coming to New Zealand Gun Laws

I don’t intend to comment generally on the shooting in New Zealand.  I’m sure enough has been said already, and besides, that isn’t what I wanted to focus on. Changes are coming to New Zealand guns laws.  Big ones, if you believe the PM.  She’s hell bent on doing it.  Apparently there is support among the general population (and read especially this comment thread), but on the other hand, New Zealand gun sales have increased since the Christchurch attack. David Codrea observes that the already r...

The invention here is a treatment claim — that is therefore patent eligible.

by Dennis Crouch The decision here is an important case adding substantial nuance to the product and law of nature exceptions. Natural Alternatives Int’l. Inc. v. Creative Compounds, LLC (Fed. Cir. 2019) Earlier this week I wrote about a separate Natural Alternatives reexamination appeal pending before the US Supreme Court on the issue of improper priority claims. The case at hand focuses on patent eligibility.  Natural Alternatives sued Creative for infringing six of its patents covering variou...

"Beto O'Rourke was the one to come up with the name 'Cult of the Dead Cow' for the hacker group in April 1985."

I'm reading the Wikipedia article "Cult of the Dead Cow" because I was blogging about Beto O'Rourke this morning, and in the comments Ron Winkleheimer said, "i'm way more interested in the fact that he was in the Cult of The Dead Cow." I said out loud, "Why did they call it Cult of the Dead Cow? Was it because they were eating hamburgers?"So I looked it up, and I see: "Beto O'Rourke was the one to come up with the name 'Cult of the Dead Cow' for the hacker group in April 1985." Splint Seventh Circuit panel tangles with Second Amendment's second-class status and felon exclusion from right to bear arms

As noted in this post from last year, Justice Thomas has lamented in a cert denial that the Second Amendment has become "constitutional orphan" seemingly relegated in some settings to second-class status.  I have long thought this second-class status is demonstrated by the willingness of lower courts to uphold lifetime, blanket prohibitions on persons with certain criminal histories from being about to possess a gun.  The Seventh Circuit had another ruling in this arena last week in Kanter v. Ba...
