Final Rule Package: Phillips Standard to be Used by PTAB in IPR Claim Construction

by Dennis Crouch The USPTO’s Final Rule Package on Inter Partes Review Claim Construction is set to publish in the Federal Register on October 11, 2018.  Up to now, the PTAB has been using the USPTO “broadest reasonable interpretation” standard to interpret challenged patent claims.  Under the new rule, the PTAB will now rely upon the PHOSITA standard more traditionally used for issued patents as articulated by in Phillips v. AWH Corp., 415 F.3d 1303 (Fed. Cir. 2005) (en banc) and further develo...

Crouch’s Supreme Court Patent Law Update

by Dennis Crouch The Supreme Court is now open for business for its 2018-2019 Calendar.  The only pending patent case before the court is Helsinn v. Teva , which focuses on the meaning of “on sale ” in the Section 102 of the Patent Act as revised by the 2011 America Invents Act.  When do pre-filing sales count as prior art — what level of public disclosure is necessary? CVSG: On October 1, the Supreme Court asked for the views of the U.S. Government in the case of RPX v. ChanBand — Whether a ...

USPTO Issues Updated PTAB Practice Guide for Post-grant Review Proceedings

By Kevin E. Noonan -- On August 8th, the U.S. Patent and Trademark Office issued revisions to its Patent Trial and Appeal Board (PTAB) Guide (see "Trial Practice Guide Update"), first promulgated in 2012 as part of the Office's implementation of inter partes review (IPR), post-grant review (PGR), and covered business methods review (CBM) proceedings established under the Leahy-Smith America Invents Act (AIA). As discussed in an accompanying memorandum from USPTO Director Iancu, this update is pa...

Petition: Is the government a person and can it infringe?

by Dennis Crouch The America Invents Act (AIA) allows for a “person” to file a covered business method review (CBM) to challenge an issued patent.  See AIA Section 18 (because they it is a temporary program, the CBM provisions have not been codified in the United States Code).  In Return Mail v. USPS, Docket No. No. 17-1594 (Supreme Court 2018), the CBM petitioner was the U.S. Postal Service – i.e., the U.S. government, and the question on petition is whether the government counts as a “person” ...

Supreme Court Vacates Secure Axcess Precedent – Finding it Moot

by Dennis Crouch As you’ll read below, the Supreme Court has vacated the Secure Axcess CBM decision on mootness grounds.  This means that the “financial services” limitation of the covered-business-method provisions are again up for interpretation.  In the America Invents Act (AIA) of 2011, Congress created a trio of AIA-Trials: Inter Partes Reviews; Post Grant Reviews; and Covered Business Method (CBM) Reviews. The CBM program is particularly targeted at claims for data processing or other oper...

Relist Watch

John Elwood reviews Monday’s relists. Everyone has been talking about the historically slow pace of decisions this year. Various explanations have been offered for the phenomenon: The Supreme Court has more controversial cases than usual and fewer unanimous decisions; the court’s early calendars were especially heavy with contentious issues; the court’s newest justice might be writing more separate opinions; or perhaps flaming rivers of magma have threatened the court’s very survival. But it see...

Introducing IPRs as the De Facto Administrative Claim Construction (ACC) Procedure

by Dennis Crouch Several years ago, I proposed an Administrative Claim Construction Procedure (ACC)— allowing a patentee or third party to request a claim-construction by the USPTO.  The process would be much like an Inter Partes Review (IPR) proceeding – although my proposal would end the proceedings before actually analyzing whether the prior art reads upon the claims. The combination of (1) the USPTO’s new proposed court-like claim-construction for IPRs and (2) the Supreme Court’s SAS decisi...

Cert Denied in Oil States Follow-On Cases

Until today, a host of patent cases have been pending before the Supreme Court — hanging onto the coattails of Oil States. Following full affirmance of the IPR regime, the Supreme Court has now denied certiorari in those cases.  The one additional case that was ripe-for-certiorari in the most recent Conference is PNC Bank National Association  v. Secure Axcess, LLC, No. 17-350.  The court issued no order in that case — suggesting that it may be up for further consideration.  In PNC, the substant...

PTAB Institutes Its First Derivation Trial: Andersen Corp. v. GED Integrated Solutions, Inc.

By Jim Lovsin -- Under the America Invents Act, the Patent Trial and Appeal Board has been busy handling inter partes review (IPR), covered business method review (CBM), and post-grant review (PGR) proceedings. Petitioners have filed thousands of petitions (nearly all for IPRs), the Board has instituted thousands of trials, and the Board has rendered thousands of final written decisions. By contrast, another AIA proceeding, derivation (DER), has received less attention. Since derivation proceedi...

United States: PTAB Denies CBM Institution Based On Technological Invention Exception - Jones Day

On December 1, 2017, the PTAB denied institution of a CBM petition because the challenged patent is directed to a "technological invention" and therefore is ineligible for CBM review under section 18 of the AIA.
