Bail bond preservation measure looks like a winner

It’s never easy to convince Californians they should reverse decisions made by the legislators they elect, as Republicans led by the failed gubernatorial candidate John Cox discovered last fall. Cox made his pet proposition, a referendum to repeal a 12-cent gasoline tax increase passed in 2017, the centerpiece of his run for governor, but saw it lose by a 57-43 percent margin, not even close. But California referenda – the term for propositions aiming to overturn laws passed by the Legislature –...

Recap of the Copyright Office’s Section 512 Study Roundtable

On Monday, I participated in a Copyright Office roundtable regarding their long-delayed report on Section 512. The roundtable was intended to update the study’s record from 2017, when progress stalled on the report. Thus, the topic nominally was to discuss how the law, especially the caselaw, had changed in the intervening years. In fact, 512 caselaw has noticeably slowed down since 2017, so there are only a handful of cases to discuss, and they reached messy results. Some cases since Jan. 1, 20...

Notable new (though incomplete) accounts of the state of death penalty politics

A couple of major news outlets had a couple of recent lengthy stories about modern death penalty politics.  Here are headlines, links, a small snippet and a follow-up comments: From NBC News, "Death penalty repeal sweeping across states as both parties get on board": Hannah Cox, the national manager of Conservatives Concerned About the Death Penalty, said that while the issue of repealing the death penalty was once a partisan one, that's changing.  It "was virtually unheard of in 2012 for a Rep...

"This is therefore the last opportunity to take advantage of our legal right," Cox told parliament, citing conclusions of a European Council summit at which the EU agreed to a delay, conditional on the withdrawal agreement being approved this week. One of Facebook’s biggest strengths risks backfiring on it after 2 key execs quit (FB)

Facebook has just lost two key execs, chief product officer Chris Cox and WhatsApp chief Chris Daniels. Their departures could spark further exits at the scandal-ridden company, an analyst is warning. Facebook has a famously mission-driven culture — meaning these high-profile departures could shake others' faith in the company. Facebook was shaken last week by the departure of two key executives — and it could be a sign of darker times to come. On Thursday, CEO Mark Zuckerberg announced that ...

From Betsy DeVos to Rupert Murdoch, to the Walton family, here are the investors that lost hundreds of millions investing in Theranos

Going into summer 2018, the blood-testing startup Theranos was running low on cash. In March, the SEC charged Theranos and its founder Elizabeth Holmes with fraud, alleging they had made false statements and misled investors while raising $700 million. In June, the Department of Justice charged Holmes and former Theranos president Sunny Balwani with wire fraud. By September 2018, Theranos — which at one point had a $9 billion valuation — officially shut down.  Theranos investors, which includ...

Court Tosses Antitrust Claims That Internet Giants Are Biased Against Conservatives–Freedom Watch v. Google

Apologies if I’m not being appropriately empathetic, but I think lawsuits alleging that Internet giants are biased against conservatives are stupid and counterproductive. They are premised on factually unsupportable assertions of bias, and most of these plaintiffs would enthusiastically cheer such bias so long as it worked against minorities or the libs. Further, there is no viable solution to “fix” bias. “Bias” is intrinsic in every media ecology, so it’s impossible to eradicate. The closest “s...

A red flag in a Facebook exec's goodbye letter shows there's bad blood over Mark Zuckerberg's radical privacy plan
