The federal death penalty at the Supreme Court

The Supreme Court is the court of last resort for death row inmates around the country. The vast majority of death row inmates are convicted and sentenced under state death penalty laws, and so most of the capital appeals that the court reviews concern state statutes. The federal death penalty is given in a small number of cases and carried out in even fewer. As a result, the history of the court’s interaction with federal capital appeals is brief, although the Department of Justice has recently...

Why are California's mayors lining up to endorse Mike Bloomberg?

London Breed, San Francisco’s first black female mayor, joins campaign following support from Stockton and San Jose mayorsThere’s nothing surprising about a billionaire winning the support of the mayor of San Francisco, a city flush with tech wealth and new money. But when the billionaire is Mike Bloomberg – and the endorsement is the latest from a string of California mayors he mentored and supported – the vow of support raises some eyebrows.Bloomberg announced on Thursday that London Breed, San...

First impressions from Travis County DA debate

Until seeing the candidates debate at a Circle-C Democrats' forum the other night, Grits had wondered whether a reform candidate could really beat incumbent Travis County DA Margaret Moore in the upcoming Democratic primary. But now I can see the path. The missus attended a second forum for District and County Attorney candidates, hosted by South Austin Democrats, the following night and came away with similar impressions.I didn't take notes and wasn't there to formally cover the event, but here ...

Is it fair that seniors get tested more often by the DMV?

Q. Dear Honk: This month I will turn 72 and am required to take a written test and an eye exam in order to get my license renewed. Why does California discriminate against seniors by having them take the written test every five years after they reach 70? It seems to me that those who should be required to take the test are those of any age who have been involved in accidents or have been issued tickets for driving infractions. In fact, the only ticket I ever received was in the ’70s, and I’ve ne...

Trump's threat to close US-Mexico border is to please voters, experts say

Under the law, what is the definition of going slow?

Q. Honk: I have a question regarding the “move over” law that requires a driver to move to an adjacent lane if possible, or if not, to slow down when encountering a stopped emergency vehicle with flashing lights on a shoulder. If you’re on a freeway/highway going at a relatively high rate of speed, but there is no opportunity to move over, how slow is slow enough? Someone I know was in that situation and slowed down, but she received a ticket because she didn’t slow down enough. What’s enough? A...

Opinion analysis: Defense lawyer’s refusal to file requested appeal constitutes ineffective assistance, despite defendant’s appeal waiver

When a defense lawyer decides not to file an appeal of a guilty plea despite his client’s request, he renders ineffective assistance of counsel, even if the client waived his right to appeal in the plea agreement, the Supreme Court ruled Tuesday in Garza v. Idaho. In a 6-3 majority opinion, Justice Sonia Sotomayor held that the presence of an appeal waiver did not render the Supreme Court’s 2000 decision in Roe v. Flores-Ortega inapplicable, as the Idaho Supreme Court had ruled below. Flores-Ort...

Amy Howe covers yesterday’s oral argument in The American Legion v. American Humanist Association, an establishment clause challenge to a World War I memorial shaped like a cross on public property, for this blog, in a post that first appeared at Howe on the Court. For The New York Times, Adam Liptak reports that the court “seemed ready … to allow a 40-foot cross honoring soldiers who died in World War I to remain in place on public land in Maryland.” For , Jess Bravin reports that the “justice...
