Authorities appear to have uncovered a vast, nefarious conspiracy to electronically rig an American election in favor of an illegitimate victor. Neither Deep State supercomputers nor Russian intelligence agencies are alleged to have been involved in this one, however. Read more...

What is a Tax Cut, Anyway?

I’m not going to write a whole blog post today about the meritless (from the point of view of precedent and doctrine) yet also highly dangerous (because conservative constitutional politics may turn out to be way more important than current precedent and doctrine) states-rights legal challenge to the American Recovery Plan Act. Lawyers apply the ordinary tools of legal analysis to a lawsuits of this sort at their peril. Read David Super’s great post below for more about the precedents. If the c...

Super Bowl 2021 ad review

We laughed—but not as much as we would have liked (though we’ll take any guffaw, chuckle or snicker we can get these days). We cried (or at least got verklempt) a few times. We also grew more than a bit annoyed (about weak creative and lost opportunities) and bored (by recycled ideas). But regardless of whether or not any given Super Bowl LV commercial clicked, overall we were pretty dazzled by the astonishing range of enterprise and ingenuity on view. After all, these commercials were create...

Thornton Wilder's Our Town is America's answer to Shakespeare

The Pulitzer-winning drama, set in the small town of Grover’s Corners, has a beating heart that will resonate through the yearsIt is frequently called the quintessential American play, but if productions of Thornton Wilder’s 1938 Pulitzer prize winner Our Town focus on its “American-ness”, they’re missing the point.Much as the Russian-set, Jewish-themed Fiddler on the Roof became an international hit in numerous languages, Our Town has lasted as one of the most produced US plays in the global mo...

A Summer Without Snow: Athletes and Coaches on a Year with No Summer Skiing

DIY Dachstein: September tracks on a snowfield in the Chugach mountains, Sept. 27, 2020. (photo: Gavin Kentch) The koan that skiers are made in the summer has been around for longer than this website. The related truism, that summer snow time is necessary to effectively compete as a high-level skier come winter, also has a venerable history.  For example, here’s Luke Bodensteiner, writing in Endless Winter about why he had journeyed to a place where “the weather sucks all year long” to...

Airtel uses specially configured routers to block websites: Why you should care

Airtel blocks access to websites using specially configured routers — called “middleboxes”, researchers have found. Centre for Internet and Society researchers Kushagra Singh and Gurshabad traced 25 middleboxes to Airtel. Their research concluded that both Airtel and Jio rely on Server Name Indication (SNI), a website identifier on a server, to carry out the blocking. “Out of the 4379 websites that the authors tested for, they found Jio to be censoring 2951 websites via SNI inspection,” their fu...

The best of Kobe Bryant’s legends and tall tales with the Lakers

Aside from the championships and aside from the statistics, Kobe Bryant had something most NBA players never achieve: mystique. Even as he was one of the biggest sports stars in the world, there were parts of the Black Mamba that seemed unknowable and enigmatic. He inspired legends as the first one to arrive the gym and the last one to leave, and his trash talk (even to his own teammates) was the stuff of myth. Even his helicopter commutes, before becoming a symbol of tragedy, were another locke...
