Court Tosses Antitrust Claims That Internet Giants Are Biased Against Conservatives–Freedom Watch v. Google

Apologies if I’m not being appropriately empathetic, but I think lawsuits alleging that Internet giants are biased against conservatives are stupid and counterproductive. They are premised on factually unsupportable assertions of bias, and most of these plaintiffs would enthusiastically cheer such bias so long as it worked against minorities or the libs. Further, there is no viable solution to “fix” bias. “Bias” is intrinsic in every media ecology, so it’s impossible to eradicate. The closest “s...

Instagram prototypes bully-proof moderated School Stories

Instagram is considering offering collaborative School Stories that only a certain school’s students can see or contribute to. And to make sure these Stories wouldn’t become bullying cesspools, Instagram’s code shows a warning that “School stories are manually reviewed to make sure the community is safe.” School Stories could create a fun space for kids to share with their peers beyond the prying eyes of their parents or strangers, though they could also exacerbate teen culture issues around ...

Section 230 Protects Twitter’s Decision to Suspend User’s Account–Mezey v. Twitter

This decision is from July but just showed up in Westlaw. Mezey sued Twitter for suspending his account. The opinion doesn’t provide any background about the account or why Twitter suspended it. The court easily dismissed the lawsuit  on Section 230 grounds. Here’s the court’s entire substantive analysis (paragraph breaks added): First, Twitter—as a platform that transmits, receives, displays, organizes, and hosts content—is an interactive computer service. 47 U.S.C. § 230(f)(2) (defining intera...

Twitter Gets Powerful Win in “Must-Carry” Lawsuit–Taylor v. Twitter

This is one of several lawsuits brought by disseminators of anti-social content (in this case, white supremacist content) seeking to prevent social media providers from cutting them off.
